hat der 4. Senat (Nichtigkeitssenat) des Bundespatentgerichts im schriftlichen Verfahren, in dem Schriftsätze eingereicht werden konnten bis zum 15. Februar 2013, durch den Vorsitzenden Richter Engels sowie die Richterin Friehe, die Richter Dipl.-Phys. Dr. rer. nat. Müller und Dipl.-Ing. Univ. Schmidt-Bilkenroth sowie die Richterin Dipl.-Phys. Univ. Zimmerer
für Recht erkannt:
I. Das europäische Patent 1 284 769 wird mit Wirkung für das Gebiet der Bundesrepublik Deutschland insoweit für nichtig erklärt, als es über folgende Patentansprüche hinausgeht:
1. A passive needle guard (10, 110, 410, 510) for a medicine syringe which includes a plunger slidably received in its proximal end to inject medicine by depressing the plunger (98), the passive needle guard comprising:
an elongate body (20, 120, 420, 520) having open proximal (22, 122, 422, 522) and distal ends (24, 124, 424, 524) and a cavity (26, 126, 426, 526) for receiving the medicine syringe therein accessible through the open proximal end;
the body having a locking mechanism (58, 158, 458) on the proximal end of the body for substantially securing the medicine syringe received in the cavity,
a shield (60, 160, 460, 560) having open proximal (62, 162, 462, 562) and distal ends (63, 163, 463, 563), the shield slidably attached to the outside of the body, the body being biased to retract with respect to the shield from a first position wherein the distal end of the body is adjacent the distal end of the shield towards a second position for withdrawing the distal end of the body proximally away from the distal end of the shield;
cooperating catches on the body (48, 148, 248, 348, 448, 548) and the shield (76. 176, 276, 376, 476, 576) for holding the body and shield in the first position; and
a latch member (74, 174, 474, 574) extending proximally from the proximal end of one of the shield and the body,
the latch member being deflectable for disengaging the cooperating catches, whereby the body may be biased to retract to the second position,
the latch member being adapted to be engaged directly by a radial portion of the plunger (98) when the plunger (98) is depressed distally into the medicine syringe to disengage the cooperating catches.
2. The passive needle guard of claim 1, wherein the locking mechanism comprises a plurality of locking detents (58, 158, 458) on a finger grip (50, 150, 450) on the proximal end of the body.
3. A passive needle guard and a medicine cartridge (90) as a medicine syringe, preferably a pre-filled syringe,
a) the passive needle guard comprising:
an elongate body (20, 120, 420, 520) having open proximal (22, 122, 422, 522) and distal ends (24, 124, 424, 524) and a cavity (26, 126, 426, 526) for receiving the medicine syringe therein accessible through the open proximal end;
the body having a locking mechanism (58, 158, 458) on the proximal end of the body for substantially securing a medicine cartridge received in the cavity,
a shield (60, 160, 460, 560) having open proximal (62, 162, 462, 562) and distal ends (63, 163, 463, 563), the shield slidably attached to the outside of the body, the body being biased to retract with respect to the shield from a first position wherein the distal end of the body is adjacent the distal end of the shield towards a second position for withdrawing the distal end of the body proximally away from the distal end of the shield;
cooperating catches on the body (48, 148, 248, 348, 448, 548) and the shield (76, 176, 276, 376, 476, 576) for holding the body and shield in the first position; and
a) latch member (74, 174, 474, 574) extending proximally from the proximal end of one of the shield and the body, the latch member being deflectable for disengaging the cooperating catches, whereby the body may be biased to retract to the second position,
b) the medicine cartridge being received in the cavity of the body through the open proximal end such that a distal tip (94, 95) of the cartridge extends beyond the distal end of the shield in the first position, and the distal tip is withdrawn into the shield in the second position,
the medicine cartridge including a plunger (98, 198, 298) slidably received in its proximal end (93), the plunger including a radial portion (9, 197, 297) for directly enganging the latch member when the plunger is depressed distally into the medicine cartridge to disengage the cooperating catches.
4. The passive needle guard of claim 3, wherein the radial portion (197, 297) is provided on an intermediate region of the plunger.
5. The passive needle guard of claim 3, wherein the radial portion comprises a thumb pad (99) on a proximal end of the plunger.
6. The passive needle guard of claim 3, wherein the latch member extends from the proximal end of the shield a predetermined distance and the radial portion is provided on a predetermined location of the plunger, such that the cooperating catches are disengaged before complete depression of the plunger.
7. The passive needle guard of claim 3, wherein the radial portion comprises a tapered distal edge (297a), whereby, upon depression of the plunger, the tapered distal edge of the radial portion engages the latch member to deflect the latch member radially outwardly to disengage the cooperating catches.
8. The passive needle guard of claim 3, wherein the distal tip of the cartridge comprises a needle (95).
9. The passive needle guard of any preceding claim, further comprising one or more finger gdps (450, 550) extending from the shield.
10. The passive needle guard of any preceding claim wherein the body and shield comprises cooperating detents (42, 71, 142, 171, 442, 471) for substantially permanently locking the body in the second position.
11. The passive needle guard of claim 10, wherein the cooperating detents comprise a detent (71, 171, 471) on the shield and a dentent pocket (42, 142, 442) on the body, the detent and detent pocket having substantially blunt proximal edges for preventing proximal movement of the shield from the second position.
12. The passive needle guard of any preceding claim, further comprising a spring mechanism (80, 180, 282, 382) coupled to the body and the shield for biasing the shield towards the second position.
13. The passive needle guard of claim 12, wherein the spring mechanism comprises a compression spring (82, 182, 282, 382) disposed between the body and the shield.
14. The passive needle guard of claim 12, wherein the spring mechanism comprises a spring (182) concentrically disposed within the shield.
15. The passive needle guard of any preceding claim, wherein the cooperating catches comprise a first catch (76, 176, 276, 376, 476, 576) on the latch member and a second catch (48, 148, 248, 348, 448, 548) on the body, the latch member being resiliently deflectable radially for disengaging the first catch from the second catch.
16. The passive needle guard of claim 15, wherein the latch member comprises an elongate finger extending proximally from the shield and having a proximal tip that is engageable by the plunger to compress and deflect the latch member radially outwardly.
17. The passive needle guard of any preceding claim, further comprising a finger grip (150) on the proximal end of the body, the finger grip including a pair of axial flanges (159) extending distally therefrom, the axial flanges being spaced away from the body to accommodate the shield sliding therebetween.
18. A method for assembling a passive needle guard (10, 110, 410, 510) according to claim 1, comprising:
providing a body (20, 120, 420, 520) having a cavity (26, 126, 426, 526) therein for receiving a medicine cartridge (90);
directing a proximal end (62, 162, 462, 562) of a tubular shield (60, 160, 460, 560) over a distal end (24, 124, 424, 524) of the body;
directing the shield towards a proximal end (22, 122, 422, 522) of the body from an extended position wherein a distal end (63, 163, 463, 563) of the shield extends beyond the distal end of the body towards a retracted position wherein the distal end of the shield is substantially coextensive with the distal end of the body;
coupling a spring (82, 182, 282) between the body and the shield, the spring biasing the shield to advance towards the extended position;
deflecting a latch member (74, 174, 474, 574) on one of the body and shield to prevent contact between mating catches on the body (48, 148, 248, 348, 448, 548) and shield (76, 176, 276, 376, 476, 576) as the shield is directed to the retacted position; and
releasing the latch member once the shield has attained the retracted position to engage the mating catches and substantially secure the shield in the retracted position.
19. The method of claim 18, further comprising inserting a medicine cartridge (90) into the cavity in the body.
20. The method of claim 19, wherein the medicine cartridge is inserted axially into the proximal end of the body.
21. The method of claim 20, wherein a locking mechanism (58, 158, 458) on the proximal end of the body engages the medicine cartridge when it is fully inserted into the cavity to substantially permanently encapsulate the medicine cartridge therein.
22. The method of claim 20, wherein the latch member is deflected radially outwardly as the medicine cartridge is inserted into the body while retaining the shield in the retracted position.
II. Die Kosten des Rechtsstreits trägt die Beklagte.
III. Das Urteil ist gegen Sicherheitsleistung in Höhe von 120 % des zu vollstreckenden Betrags vorläufig vollstreckbar.
Die Beklagte ist eingetragene Inhaberin des europäischen Patents 1 284 769 (Streitpatent), das am 1. Mai 2001 angemeldet worden ist. Das Streitpatent betrifft eine passive Nadelabschirmung für Spritzen und umfasst in der erteilten Fassung 24 Ansprüche. Hinsichtlich der erteilten Patentansprüche wird auf die Streitpatentschrift EP 1 284 769 B1 Bezug genommen.
Nachdem die Klägerin mit der Klage das Patent vollständig angegriffen hatte, hat die Beklagte erklärt, es nur noch in der im Urteilstenor wiedergegebenen Fassung zu verteidigen. Daraufhin hat die Klägerin erklärt, diese Fassung nicht angreifen zu wollen. Beide Parteien haben sich mit einer Entscheidung im schriftlichen Verfahren einverstanden erklärt.
I.
Die zulässige Klage führt aufgrund der zulässigen beschränkten Verteidigung des Patents durch die Beklagte und der als teilweise Klagerücknahme auszulegenden Erklärung der Klägerin, die im Rahmen dieser Selbstbeschränkung der Beklagten verteidigte Fassung des Streitpatents nicht angreifen zu wollen, ohne weitere Sachprüfung zur Nichtigerklärung des Streitpatents in dem im Urteilstenor ausgesprochenen Umfang.
Nach ständiger Rechtsprechung kann die Patentinhaberin im Nichtigkeitsverfahren das Streitpatent im Umfang des Angriffs auch ausschließlich beschränkt verteidigen mit der Folge, dass das insoweit nicht mehr verteidigte Patent ohne weitere Sachprüfung für nichtig zu erklären ist, da eine sachliche Überprüfung nur im Rahmen der von den Streitparteien bindend gesetzten Grenzen zu erfolgen hat (BGH GRUR 2005, 145, 146 – elektrisches Modul; BPatG GRUR 2009, 46, 49 – Ionenaustauschverfahren; BPatG GRUR 2009, 1195 – Kostenverteilung aus Billigkeitsgründen; Keukenschrijver, Patentnichtigkeitsverfahren, 4. Aufl., 2011, Rdn. 226 ff.; zur Selbstbeschränkung auf Null vgl. auch Senat Urt. v. 18.7.2012, 4 Ni 3/12; BPatG GRUR 2010, 137 – Oxaliplatin).
Die von der Beklagten zuletzt verteidigte Fassung der angegriffenen Patentansprüche erweist sich als patentrechtlich zulässig und ermöglicht deshalb eine entsprechende beschränkende Gestaltung des Streitpatents durch das erkennende Urteil.
II.
Die Kostenentscheidung beruht auf § 84 Abs. 2 Halbs. 1 PatG i. V. mit § 91 Abs. 1 ZPO, die Entscheidung über die vorläufige Vollstreckbarkeit auf § 99 Abs. 1 PatG i. V. mit § 709 Satz 1 und Satz 2 ZPO. Danach sind unter Billigkeitsgesichtspunkten die Kosten des Verfahrens trotz der teilweisen Klagerücknahme ausschließlich der Beklagten aufzuerlegen.
Der Senat teilt die Auffassung, dass die Klägerin auch bei einer nur teilweisen Nichtigerklärung des Streitpatents dann keine anteilige Kostenlast trifft, wenn sie bei Klageerhebung keine Möglichkeit hat, ihre Klage bereits insoweit eingeschränkt zu erheben, was insbesondere dann der Fall ist, wenn – wie vorliegend – die angegriffenen Patentansprüche durch Aufnahme weiterer Merkmale beschränkt werden und das Streitpatent insoweit zulässig verteidigt wird. Denn der Klägerin ist es verwehrt, einen Patentanspruch in der Weise beschränkt anzugreifen, dass der Inhaber des Streitpatents durch eine in den Klageantrag aufgenommene Neufassung des angegriffenen Patentanspruchs festgelegt wird. Die Klägerin ist auch aus Kostengesichtspunkten nicht verpflichtet, derartige, für sie akzeptable Beschränkungen vorgerichtlich oder im Rahmen der Klage vorzuschlagen, da den Patentinhaber und nicht die Klägerin Rechte und Pflichten aus dem Patent treffen und es deshalb auch nicht ihre Aufgabe ist, zur Begrenzung des Streitgegenstands und Kostenrisikos Beschränkungen vorzuschlagen. Zudem würde die dem Patentinhaber nach der ständigen Rechtsprechung aus Gründen der Prozessökonomie gewährte Gunst, zur Beschränkung seines Patents nicht stets auf ein isoliertes Beschränkungsverfahren i. S. von § 64 PatG bzw. Art. 105a EPÜ ausweichen zu müssen, sondern diese auch im Verlauf des Nichtigkeitsverfahrens herbeiführen zu können (BGH GRUR 2005, 145, 146 – elektrisches Modul), zu einer für die Klägerin unbilligen kostenmäßigen Verschiebung des isolierten Beschränkungsverfahrens in das Nichtigkeitsverfahren führen (BPatG GRUR 2009, 46, 50 – Ionenaustauschverfahren, m. w. H.).
Hiervon ausgehend ist deshalb aufgrund der ergänzend heranzuziehenden Billigkeitsgründe gem. § 84 Abs. 2 Satz 2 PatG abweichend vom Unterliegensprinzip und den entsprechend geltenden Kostengrundsätzen der §§ 91 ff., 269 Abs. 3 ZPO der Patentinhaberin das mit der Möglichkeit einer zulässigen Beschränkung durch Neufassung des Patentanspruchs verbundene Kostenrisiko aufzubürden, welches hinsichtlich des überschießenden ursprünglichen Klageantrags entsteht, wenn die im Verlaufe des Verfahrens beschränkt verteidigte Fassung des Streitpatents nicht angegriffen wird und die Klägerin sich mit dieser Fassung sofort einverstanden erklärt (BPatG GRUR 2009, 46, 50 – Ionenaustauschverfahren, m. w. H.).
